Welcome to EverCrest Notary Solutions LLC (“EverCrest,” “Company,” or “I”). These Terms of Service govern your use of this website, online booking system, and notary services provided by EverCrest Notary Solutions LLC.
By using this website or scheduling an appointment, you agree to these Terms and to comply with all applicable laws governing notarial acts in the State of Texas.
All notarial acts are performed in accordance with Texas Government Code Chapter 406 and applicable administrative rules issued by the Texas Secretary of State.
Scope of Services
EverCrest Notary Solutions LLC provides professional notarization services for documents permitted under Texas law, including but not limited to:
• Estate planning and probate documents
• Legal affidavits and sworn statements
• Facility-based notarizations (assisted living, nursing facilities, rehabilitation centers, hospitals, and similar environments)
• Real estate document notarizations (non-loan)
Services may be requested by attorneys, title companies, or authorized representatives acting on behalf of the signer.
Signer Requirements
Texas law requires that each signer:
• personally appear before the notary at the time of notarization
• appear willing to sign the document voluntarily
• appear aware and capable of understanding the document being signed
• communicate directly with the notary
If these conditions are not met, the notarization must be refused as required by Texas law.
Identification Requirements
All signers must present valid government-issued photo identification consistent with Texas notary law.
Acceptable identification may include:
• driver’s license
• state identification card
• passport
• other government-issued photo identification permitted under Texas law
If identity cannot be properly verified, the notarization must be refused.
Appointment Readiness
Clients are responsible for ensuring that documents are complete and ready for notarization at the scheduled appointment time.
Signers must have valid identification available and any required witnesses present.
If required documents, identification, or witnesses are not available at the time of the appointment, the notarization cannot be completed, and the appointment will be considered a completed service visit.
Facility-Based Appointments
For appointments conducted at hospitals, assisted living facilities, nursing homes, or other care environments, the signer must be alert, willing, and able to communicate directly with the notary.
If the signer cannot demonstrate awareness of the document, appears to be under duress, or facility staff restrict access to the signer, the notarization cannot be completed.
In these circumstances, the appointment will be considered a completed service visit, and all applicable fees will remain due and payable.
Payment & Booking
Appointments may be scheduled through the website booking system.
Fees may include:
• state-authorized notarial fees
• travel fees
• extended distance fees
• expedited or same-day appointment fees
For professional clients, services may be invoiced with payment terms provided upon engagement.
Payment reserves the notary’s professional time and travel for the scheduled appointment.
Wait Time
Appointments include a reasonable amount of time for document review and signing.
Extended wait times beyond the scheduled appointment may result in additional fees in accordance with posted pricing.
Travel & Location Fees
Travel fees are based on distance from the primary service area and may vary based on location.
Parking fees, tolls, or other location-specific costs may be passed through at actual cost when required.
Notarial Record Keeping
Records of notarial acts may be maintained as permitted under Texas Government Code §406.014.
Recorded information may include:
• date and time of the notarization
• type of notarial act
• description of the document
• identification presented
• name of the signer
Records are maintained for compliance and fraud prevention.
Prohibited Acts
EverCrest Notary Solutions LLC will not:
• provide legal advice
• prepare legal documents
• notarize documents when identity cannot be verified
• notarize documents when the signer does not personally appear
• notarize documents when the signer appears unwilling or unable to understand the document
If any of these circumstances exist, notarization must be refused.
Fraud Prevention & Refusal of Service
EverCrest Notary Solutions LLC reserves the right to refuse any notarization request if the notary reasonably believes that the transaction may involve fraud, coercion, illegal activity, or circumstances that do not comply with Texas notary law.
The notary may also refuse service if:
• the signer cannot be properly identified
• the document appears incomplete or suspicious
• the signer appears unwilling, under duress, or unable to communicate awareness of the transaction
• the requested notarial act is outside the authority of a Texas notary public
Refusal of service in these circumstances is required to maintain compliance with Texas Government Code Chapter 406 and to protect the integrity of the notarization process.
Travel and service fees may still apply even after the notary has arrived at the appointment location.
Document Responsibility
Clients are solely responsible for the preparation, accuracy, and legal sufficiency of any documents presented for notarization.
EverCrest Notary Solutions LLC does not draft, review, or verify the legal correctness of documents and does not determine whether a document is appropriate for a particular legal or financial transaction.
The role of the notary is limited to verifying identity, witnessing signatures, and completing the notarial certificate in accordance with Texas law.
EverCrest Notary Solutions LLC shall not be responsible for errors, omissions, or legal consequences arising from documents prepared by clients or third parties.
Limitation of Liability
EverCrest Notary Solutions LLC is not responsible for:
• errors or omissions in documents prepared by clients or third parties
• the legal validity of documents
• delays caused by third-party platforms or scheduling systems
Services are provided on an “as-is” basis without warranties of any kind, to the fullest extent permitted by law.
Governing Law
These Terms are governed by the laws of the State of Texas.
Any disputes arising from these Terms shall be resolved in the courts of Montgomery County, Texas.
Updates
EverCrest Notary Solutions LLC reserves the right to update these Terms at any time. Updated versions will be posted on this website with a revised effective date.
