A Note on Capacity

I am experienced in coordinating signings in assisted living, memory care, rehabilitation, hospice, and hospital environments where additional sensitivity and patience may be required.

I do not assess legal or medical capacity. That determination remains the responsibility of the client’s physician and legal counsel.

I observe signing conditions carefully and will not proceed when clear concerns exist. Any concerns are communicated to the referring attorney.

Documents Commonly Notarized

Estate planning signings often involve multiple documents, witness coordination when required, and precise execution standards. Each appointment follows a structured process to ensure compliance with Texas notary law and the requirements of the referring attorney.

Estate Planning

  • A will outlines how a person wishes their assets and property to be distributed after death. Many wills include a self-proving affidavit that is notarized to confirm the authenticity of the signatures of the testator and witnesses.

  • Trust documents establish instructions for managing and distributing assets. These may include revocable or irrevocable trust agreements, trust amendments, certifications of trust, and trustee acceptance documents.

  • A durable power of attorney authorizes another individual to act on someone’s behalf for financial or legal matters and can remain effective even if the individual becomes incapacitated

  • Advance directives communicate a person’s wishes regarding medical treatment and end-of-life care when they are unable to express those wishes.

  • A HIPAA authorization allows healthcare providers to release medical information to designated individuals.

Healthcare & Elder Planning

  • Healthcare planning documents may include advance directives, living wills, and other medical decision forms executed in hospitals, assisted living communities, rehabilitation centers, or nursing facilities.

  • A medical power of attorney allows a designated individual to make healthcare decisions for another person if they are unable to communicate or make decisions themselves.

  • Guardianship documents may include affidavits or declarations related to guardianship of minor children or incapacitated adults when notarization is required.

  • Certain legal documents associated with elder care planning, long-term care arrangements, or benefit coordination may require notarization to confirm the identity and signature of the signer.

Probate & Property

  • An affidavit of heirship is a sworn statement used to establish the heirs of a deceased person, often when property ownership must be transferred without formal probate proceedings.

  • Various affidavits may be required during probate or estate administration, including sworn statements confirming facts related to the estate or executor responsibilities.

  • A transfer on death deed allows real property ownership to transfer to a named beneficiary upon the death of the property owner without going through probate.

  • A sworn statement used in Texas probate to transfer certain assets of a deceased person when the estate qualifies under state law.

I verify signer identity, confirm personal appearance, and complete the notarial certificate in accordance with Texas Government Code Chapter 406 and applicable administrative rules.

I do not provide legal advice, document preparation, or interpretation of legal documents.
